The following words and terms, when used in this subchapter, shall have the following meanings, unless the context clearly indicates otherwise.

1. (1) Department--The Texas Department of Transportation.
2. (2) District engineer--The chief administrative officer of a district of the department.
3. (3) Division director--The chief administrative officer of a division of the department.
4. (4) Executive director--The chief administrative officer of the department.

5. (5) Intellectual property--Ideas, publications, and other original innovations fixed in a tangible medium, including, but not limited to:

   1. (A) literary works;
   2. (B) logos;
   3. (C) service marks;
   4. (D) studies;
   5. (E) maps and planning documents;
   6. (F) engineering, architectural, and graphic designs;
   7. (G) manuals;
   8. (H) automated systems software;
   9. (I) audiovisual works;
   10. (J) sound recordings;
   11. (K) travel literature, including but not limited to pamphlets, bulletins, books, maps, periodicals, and electronic information published or produced under Texas Civil Statutes, Article 6144e; and
   12. (L) mechanical devices.
6. (6) Office director--The chief administrative officer of an office of the department.
7. (7) Unregistered--Intellectual property that is not registered with the U.S. Copyright Office or U.S. Patent and Trademark Office.
