A displacee who feels he has been aggrieved by a determination as to eligibility or as to relocation payments and services may have his application reviewed by the Relocation Review Committee. This administrative committee is appointed by the state engineer-director and is presently composed of the assistant state engineer-directors for operations (chairman) and administration, chief engineer of maintenance operations, and personnel and wage administrator. The review procedures are as follows.
- (1) Applications must be filed with the appropriate district office within 24 months after the applicant was required to move or within 24 months after the date he actually moved, if earlier.
- (2) The district engineer will promptly and carefully review the facts and shall endeavor to resolve the matter at district level. The displacee will be promptly notified in writing of the results of the district engineer's review.
- (3) If the displacee is still dissatisfied after the first review, he may request that the district engineer's decision be reviewed by the department's Relocation Review Committee.
- (4) The district shall promptly forward the application together with all the information the district has relating to the displacee's application and the district engineer's personal recommendation. The assembly will then be presented to the Relocation Review Committee.
- (5) The Relocation Review Committee shall give each displacee full opportunity to be heard, carefully review all facts presented, and render a prompt decision. The decision will be supported by the necessary rationale and documented in the parcel file.
- (6) The committee shall have the prerogative of counseling with the state engineer-director on any application which they feel requires such action. The state engineer-director shall maintain the prerogative of making the final ruling himself or counseling with the commission where circumstances warrant.
- (7) Any displacee advancing an application under the relocation assistance program who may be dissatisfied with the decision of the Relocation Review Committee may upon written request have his application reviewed by the state engineer-director.
