43 Tex. Admin. Code § 21.114
Relocation payments and services are applicable to all individuals, families, businesses, farm operations, or nonprofit organizations who have held lawful physical occupancy and who are displaced as a result of the acquisition of their real property, in whole or in part, for highway right-of-way purposes. Where displaced individuals or families occupy living quarters on the same premises as a displaced business, farm or nonprofit organization, such individuals or families are separate displacees for purposes of determining entitlement to relocation payments. A displaced person can refuse relocation services and still be eligible for payments. He can relocate on his own; however, he must relocate so as to meet all eligibility requirements in order to qualify for payments.
