43 Tex. Admin. Code § 11.52 – Access Driveway Facilities Outside the Corporate Limits of Municipalities

(a) For commercial and private driveways, the cost of materials, installation and maintenance shall be the responsibility of the grantee.
(b) For public driveways, the cost of materials and installation shall be the responsibility of the grantee. The department shall maintain all portions of public access driveways which lie within the state highway right-of-way and which are the maintenance responsibility of the department.
