Following written request by a party or on the motion of the hearing officer, the hearing officer shall issue in the name of the department a written commission addressed to officers authorized by statute to take a deposition of a witness. Such commission shall be issued only after the deposit of sums sufficient to insure payment of expenses incident to the deposition. The use of depositions in any proceeding shall be governed by the APA.
