43 Tex. Admin. Code § 1.34
Subject to the provisions of §1.32 of this title (relating to Service), upon receipt of any filing the hearing officer shall examine the same and determine its sufficiency under these sections. If the hearing officer finds that the filing does not comply in all material respects with these sections, the hearing officer shall return it to the person who filed it, along with a statement of the reasons for rejecting the same. The person who made the filing shall thereafter have the right to file a corrected instrument, if doing so will not delay any hearing unless the hearing officer determines that such delay is necessary to prevent injustice or to protect the public interest and welfare.
