Appeal of Grant Awards

- (a) Appeals from applicants for grants who did not receive funding, or from grantees whose grants have been suspended or terminated, shall be received, processed, and resolved with fairness and promptness. The person appealing shall be known as the appellant.
- (b) The appellant shall file an appeal in writing addressed to the executive director of the Council. The written appeal must be postmarked within 15 days of the date of the written notice of denial, suspension, or termination. The executive director will acknowledge receipt of the letter with a copy to the commissioner.
- (c) The executive director will investigate, compile, and study all relevant information about the appeal and, within 30 days of the receipt of the appellant's letter, submit a written report to the commissioner and Council Chair. The report will contain recommended action and the evidence supporting the recommended action.
- (d) The commissioner will review the report of the executive director and may approve the recommendations of the executive director, makes such modifications as deemed appropriate, orders further investigation, or takes other appropriate action. The commissioner shall consult with the Council Chair prior to making any final decision. The commissioner shall notify the appellant of his decision. The decision of the commissioner is final.
