1. (a) Educational services are only available for mandatory individuals and exempt recipients who voluntarily participate in Choices services, who have not completed secondary school or who have not received a certificate of general equivalence as follows.

   1. (1) Educational services for mandatory individuals, and exempt recipients who voluntarily participate in Choices services, age 20 or older are non-core activities as defined in §811.25(a)(2) of this chapter.
   2. (2) Educational services for mandatory individuals, and exempt recipients who voluntarily participate in Choices services, who are teen heads of household age 19 and younger are core activities as defined in §811.29 of this chapter.

2. (b) A Board shall ensure that a determination is made, on a case-by-case basis, whether to authorize, arrange, or refer mandatory individuals, and exempt recipients who voluntarily participate in Choices services, who are age 20 and older for the following educational or other training services:

   1. (1) secondary school leading to a high school diploma or a certificate of general equivalence;
   2. (2) Workforce Adult Literacy; or
   3. (3) other educational activities which are directly related to employment.

3. (c) Boards may count up to 5 hours per week of study or homework time toward a mandatory individual, and exempt recipient who voluntarily participates in Choices services, family participation requirement if:

   1. (1) study or homework time is directly correlated to the demands of the course work for out-of-class preparation as described by the educational institution;
   2. (2) the educational institution's policy requires a certain number of out-of-class preparation hours for the class;
   3. (3) study or homework time has been directly verified from the educational institution; and
   4. (4) the mandatory individual, or exempt recipient who voluntarily participates in Choices services, is making progress as determined by the educational institution.
