1. (a) A parent is ineligible to reapply for child care services or to be placed on the waiting list for services for 60 calendar days if the parent's eligibility or the child's enrollment is terminated due to:

   1. (1) excessive unexplained absences under §809.78 of this chapter; or
   2. (2) nonpayment of parent share of cost pursuant to a Board's established policy under §809.19 of this chapter.

2. (b) To ensure full alignment between Child Care Services rules and the Choices program requirements, the provisions of subsection (a) of this section will not apply to individuals who, during the 60-calendar day waiting period:

   1. (1) become Choices participants who require child care to participate in Choices; or
   2. (2) are on Choices sanction status and require child care to demonstrate participation in Choices.
