1. (a) A child of a teen parent may be eligible for child care if:

   1. (1) the teen parent needs child care services to complete high school or the equivalent; and
   2. (2) the teen parent's family income does not exceed the income eligibility limit established by the Board. Boards may establish a higher income eligibility limit for teen parents provided that the higher income limit does not exceed 85% of the state median income for a family of the same size.
2. (b) The teen parent's family income is based solely on the teen parent's income and size of the teen's family as defined in §809.2(8).
