Fair Hearings

- (a) Child protective services clients have the right to a fair hearing if services they request are denied, reduced, or terminated or if the Texas Department of Protective and Regulatory Services (PRS) does not act on their request for services with reasonable promptness.
(b) When PRS staff informs a client that requested services have been denied, reduced, or terminated or will not be provided with reasonable promptness, staff must also inform the client:
- (1) that the client may request a fair hearing to question PRS action;
- (2) the procedures for requestng a fair hearing; and
- (3) that the client may be represented at the hearing by others, including legal counsel.
- (c) If requested, PRS staff assists the client in completing the form for requesting a fair hearing.
