- (a) To obtain criminal history records on volunteers or volunteer applicants, the agencies authorized by law to obtain these through the Texas Department of Protective and Regulatory Services (TDPRS) must give TDPRS identifying information about the applicant on a form designated by TDPRS for that purpose.
- (b) The volunteer agency must ensure that the person on whom the information is being requested has consented in writing to TDPRS disclosing the information to the volunteer agency.
- (c) TDPRS discloses the criminal history information received from the Texas Department of Public Safety directly to the volunteer agency that requests it, although TDPRS must not give the volunteer agency a copy of the information or allow the volunteer agency to make a photocopy of the information.
- (d) TDPRS retains the criminal records check information obtained on behalf of the volunteer agency only as long as is needed to ensure that the volunteer agency has received the information and then TDPRS deletes or destroys the information.
- (e) TDPRS may charge an organization that requests criminal record history information a fee in the amount necessary to cover the costs of obtaining the information on the organization's behalf.
