An applicant may submit an application to the commercial lender for the program if the applicant meets the following requirements:

1. (1) is a United States citizen and a resident of the State of Texas;
2. (2) provides evidence of the fact that the applicant's farm or ranch operation will be located within the state;
3. (3) provides evidence of a minimum equity in the farm or ranch operation; and
4. (4) is an eligible applicant as set forth in the Act and this chapter.
