1. (a) Applications for "Texas Yes!" community, business or associate membership shall be made in writing on a form, prescribed by the Department, to the Assistant Commissioner for Marketing and Promotion, Texas Department of Agriculture, P.O. Box 12847, Austin, Texas 78711.
2. (b) Application forms may be obtained by contacting the Texas Department of Agriculture Marketing and Promotion Division at P.O. Box 12847, Austin, Texas 78711, phone 1-866- 483-9937 (866- 4TEXYES).
3. (c) Within 30 days of receipt of an application for "Texas Yes!" community, business, or associate membership, the department shall grant or deny the application and forthwith notify the applicant in writing of the decision setting forth in detail the reasons for such grant or denial.

4. (d) The department, in its sole discretion, may deny an application for "Texas Yes!" community, business or associate membership if:

   1. (1) the application is not made in compliance with these rules; or
   2. (2) for any other reason.
5. (e) Once an applicant has been approved for membership, the membership remains in effect until revoked by the department.
