The term certified budwood or certified citrus budwood shall only be applied to budwood that is documented to be:
- (1) produced in either a foundation grove or an increase block approved by the department in compliance with Subchapter D of this chapter (relating to Citrus Nursery Stock Certification Program); and
(2) taken from a tree that is:
- (A) of an assured type of citrus variety;
- (B) found to conform to the description of the type of citrus variety; and
- (C) tested with negative results for pathogens listed under §21.32(a) of this chapter (relating to Establishment of the Foundation Grove); and
- (3) kept from exposure to the listed pathogens prior to its use.
