If an award and payment is made from the fund and the license holder, or person required to be licensed, fails to reimburse and/or fails to agree in writing to reimburse the fund and/or the aggrieved party, after 90 days, the department shall initiate proceedings to cancel the license holder's license in accordance with the Texas Agriculture Code (Code), §103.009. Such proceedings shall be conducted in accordance with the Code, §12.032, the Administrative Procedure Act, and the department's General Rules of Practice and Procedure found at Chapter 1, Subchapter A of this title (relating to General Practice and Procedure).
