(a) To qualify for a firearms proficiency certificate, an applicant must:
- (1) not be prohibited by state or federal law or rule from attending training related to firearms or from possessing a firearm;
- (2) be currently employed as a community supervision officer, probation officer or parole officer by the Texas Department of Criminal Justice (TDCJ) or a community supervision and corrections department; and
- (3) have successfully completed the commission's current firearms program for supervision officers.
- (b) The holder of a certificate issued under this section must qualify in a course of fire determined by the commission at least once every 12 months.
- (c) Certificates issued under this section expire two years from date of issuance. Upon expiration, a supervision officer may apply for issuance of a renewal certificate. The standards for issuance of a renewal certificate are the same as those for a new certificate, except that the applicant is not required to repeat the commission's current firearms program.
- (d) The effective date of this section is June 1, 1998.
