1. (a) The commission and its records are governed by the Open Records Act. However, to protect the security of an undercover operation and its law enforcement participants, the commission may, upon request to the commission's custodian of records, temporarily remove from its routinely accessed files the records of an individual license holder.
2. (b) Such request may be informally accepted, but should be in writing from the chief administrator including the name, social security number, agency, and approximate dates of the undercover operation, without including any other details of that operation.
3. (c) Such request should not be for more than 12 months and may be renewed.
4. (d) While a record is in an undercover status, the commission will respond in the negative to any request on the license or appointment status of that license holder.
5. (e) The effective date of this section is February 1, 1989.
