1. (a) The facility administrator shall ensure that the educational program provides for at least 180 days of instruction unless:

   1. (1) a waiver has been granted by the TEA for fewer days; or
   2. (2) the number of educational days coincides with the local school district calendar.

2. (b) An education service provider is required to provide a full educational day. An educational day is required to:

   1. (1) be seven hours long; and
   2. (2) consist of at least five and one-half hours of required secondary curriculum to students.
