1. (a) An instructor may not use the State Seal of Texas in advertising or promotional materials. Private use of the State Seal of Texas for advertising or commercial purposes is a violation of Business and Commerce Code, §17.08. Violation is a misdemeanor and a deceptive trade practice as provided by that section.
2. (b) An instructor may not use the department's name or insignia, or the name of any division of the department, in advertising or promotional materials. Use of the Department name or insignia or Division name is a violation of Texas Government Code, §411.017. Violation is a criminal offense (Class A misdemeanor or third degree felony), as provided by that section.
