- (a) Time to collect. The institutional division shall obtain the sample or specimen from an inmate of the institutional division during the diagnostic process. The division shall collect a blood sample from an inmate confined in the division who has completed the diagnostic process before February 1, 1996, not later than the 90th day before the inmate's earliest parole eligibility date.
- (b) Use of force. An employee of the institutional division may use force against an inmate required to provide a sample or specimen under this subchapter when and to the degree the employee reasonably believes the force is immediately necessary to obtain the sample or specimen.
- (c) Contracts. TDCJ may contract for phlebotomy services under this subchapter.
