The following words and phrases, when used in this chapter, shall have the following meanings, unless the context shall clearly indicate otherwise.
- (1) CODIS--The Combined DNA Index System used by the FBI.
- (2) CODIS user laboratory--A DNA laboratory which the department has authorized to access the department's DNA database, and to submit DNA records to the department's DNA database.
- (3) Criminal justice or law enforcement agency--The Texas Department of Criminal Justice, the Texas Youth Commission, the Texas Juvenile Probation Commission, the Criminal Justice Policy Council, a community supervision or probation department of this state, a criminal justice agency described by Texas Government Code §411.082, a city police department of this state, a county sheriff's department of this state, the Texas Department of Public Safety, or another agency or subdivision of this state which is authorized to employ or commission peace officers.
- (4) Department--The Texas Department of Public Safety, including employees of the department.
- (5) Director--The Director of the Texas Department of Public Safety or the director's designee.
- (6) DNA--Deoxyribonucleic acid.
- (7) DNA database--The database that contains forensic DNA records maintained by the department.
- (8) DNA laboratory--A laboratory that performs forensic DNA analysis on samples or specimens derived from a human body or crime scene.
- (9) DNA record--The results of a forensic DNA analysis performed by a DNA laboratory and, if know, the name of the person who is the subject of the analysis.
- (10) FBI--The Federal Bureau of Investigation.
- (11) Institution of higher education--Has the meaning assigned by Education Code §61.003.
- (12) Institutional division--The institutional division of the Texas Department of Criminal Justice.
- (13) Penal institution--Has the meaning assigned by Texas Penal Code §1.07.
