37 Tex. Admin. Code § 16.5
Tow truck operators are treated the same as other drivers of commercial motor vehicles (CMV). When a tow truck operator's vehicle plus its load meets the 26,001 pounds or more standard, or any condition which makes a motor vehicle a CMV, the operator is required to have a commercial driver's license (CDL). Tow truck operators are required to have appropriate endorsements for the vehicles that they tow except for passenger carrying and except when the operator is an emergency operator only and only moves the towed vehicle from the site of a malfunction or accident to the nearest appropriate repair facility.
