37 Tex. Admin. Code § 15.52
The department administers examinations to determine an applicant's knowledge of the traffic laws of Texas and such applicant must meet a predetermined score of 70% correct, or better, on each test to qualify for a drivers license. Although the applicant must understand highway signs in the English language and must have a knowledge of the traffic laws of the state, literacy itself is not a condition which must be met before a Texas drivers license can be issued. Understanding is not considered to be synonymous with speaking the language. Oral tests will be administered when actually needed.
