34 Tex. Admin. Code § 67.71
Official notice may be taken of judicially cognizable facts, and such notice may be taken of generally recognized facts within the area of the specialized knowledge of the Employees Retirement System of Texas. Parties shall be notified of the material noticed, including any staff memoranda or data; and they shall be afforded an opportunity to contest the material so noticed. The special skills or knowledge, or both, of the Employees Retirement System of Texas and its staff may be utilized in evaluating the evidence.
