34 Tex. Admin. Code § 67.53
Hearings will be conducted by hearings examiners, any and all of whom are at times referred to in this chapter as the examiner. The examiner shall have authority to administer oaths, to examine witnesses, and to rule upon the admissibility of evidence and amendments to pleadings. He shall have the authority to recess any hearing from day to day. If the examiner is unable to continue presiding over a case at any time before the final decision, another examiner will be appointed who shall perform any function remaining to be performed without the necessity of repeating any previous proceedings.
