Retirees receiving service retirement annuities forfeit those annuities in any month in which they are employed by a public educational institution covered by the Teacher Retirement System of Texas, except in the cases set forth in §31.3 of this title (relating to Permissible Substitute Employment), §31.7 of this title (relating to Regular Employment Having No Effect on Annuity), and §31.12 of this title (relating to Employment up to Six Months on as Much as Full Time). However, the exceptions provided in those sections do not apply to the statutory requirement that a person automatically revokes retirement if employed in any position in Texas public educational institutions in the month immediately following the person's effective date of retirement (or in the two months immediately following the person's effective date of retirement if the date of retirement has been set on May 31 under §29.14 of this title (relating to Eligibility for Retirement at the End of May)).
