- (a) Member contributions, including contributions picked-up by the employer pursuant to Government Code §825.409, may not be withdrawn prior to the time the member terminates employment in all positions with a TRS-covered employer, except as otherwise provided by this section.
- (b) A member who is employed by an employer included in the Teacher Retirement System of Texas in a position which is not eligible for membership may terminate his or her membership and withdraw his or her deposits, other than any deposits picked up by the employer pursuant to the Texas Government Code, §825.409. However, a member who continues to be eligible for membership by virtue of previous employment during the school year, including a member described in §25.6 of this title (relating to Part-time or Temporary Employment), must continue to make any applicable contributions during the remainder of the school year and may not withdraw his or her deposits until the member terminates all employment for a TRS-covered employer in the school year.
- (c) Any withdrawal must be a complete withdrawal. No partial withdrawals are allowed.
