Applicability Determination and Notification Procedures

- (a) By October 15 of each year, each state agency shall determine which persons are required to electronically transfer payments to the state agency.
(b) Based on the determination in subsection (a) of this section, by November 1 of each year, each state agency shall notify all persons newly required to electronically transfer payments to the state agency by sending said persons the following information:
- (1) guidelines as to when and how the payments must be transferred;
- (2) a payor information form;
- (3) the telephone number of the contact person at the state agency with whom a person may communicate in the event of questions or problems; and
- (4) such other information the state agency or the Treasury deems necessary.
- (c) State agencies shall not be required to notify persons whose applicability status has not changed from the preceding state fiscal year, nor shall state agencies be required to notify persons who are no longer required to electronically transfer payments. Persons who are no longer required to electronically transfer payments shall be considered voluntary payors as set forth in §15.7 of this title (relating to Voluntary Payments by Electronic Funds Transfer).
- (d) Following the applicability determination and notification dates listed in subsections (a) and (b) of this section, all persons required to electronically transfer payments to a state agency shall do so beginning on the date set forth in the notification and thereafter until the person no longer meets the payment thresholds set forth in §15.1(a) or (b) of this title (relating to Applicability) and does not wish to participate as a voluntary payor as set forth in §15.7 of this title (relating to Voluntary Payments by Electronic Funds Transfer).
- (e) A person may contact the state agency to which payments are due for a determination of applicability at any time.
