(a) Pursuant to Texas Government Code, §404.095, the following rules shall apply to:
- (1) all state agencies that collected or received more than $50 million in payments during the preceding state fiscal year in fees, fines, penalties, taxes, charges, gifts, grants, donations, and other funds, excluding federal grants and interest and dividend income; and
- (2) a person that paid a state agency, subject to paragraph (1) of this subsection, a total of $500,000 or more in the preceding state fiscal year in a category of payment and the agency reasonably anticipates that during the current state fiscal year the person will pay the agency $500,000 or more in the same category of payment.
- (b) An agency may adopt rules under Texas Government Code, §404.095, that require a person to transfer all payments by electronic funds transfer. The following rules also apply to all persons who are subject to said agency rules.
