Cooperation with Other States

(a) A holder of abandoned mineral proceeds and/or abandoned mineral interests under the Property Code, Title 6, Chapter 75, is not required to deliver such property to the Texas State Treasurer pursuant to the Property Code §74.301, if:
- (1) the owner's last known address is located in a state whose abandonment period for mineral proceeds or mineral interests is three years or less; and
- (2) the mineral proceeds or mineral interest has already been paid or delivered to another state.
- (b) A holder of mineral proceeds and/or mineral interests as described in subsection (a) of this section shall, however, beginning with the report due on November 1, 1986 report such property to the Texas State Treasurer pursuant to the Property Code, Title 6, Chapter 74, Subchapter B. Report of property described in subsection (a) of this section is hereby expressly waived for the reports due November 1, 1985 only.
