Report and Remittance to Other States

- (a) The Texas State Treasurer shall report and remit property held for other states to the state of last known address of the missing owner. If there is no last known address or if the state of last known address has no provisions for claiming the property, then the Texas State Treasurer shall report and remit property to the state of incorporation of the holder, or if the holder is not a corporation, then to the state of domicile of the holder. The property will be reported and remitted beginning in the year that it is first presumed abandoned under the respective state's unclaimed property law.
- (b) This regulation tracks the holding of Texas v. New Jersey, 379 U.S. 674 (1965) which sets out the priority scheme to be followed when two or more states make competing and contemporaneous claims for the same property.
