- (a) The holder's right to indemnification, provided for in the Property Code, Title 6, §74.304(c), from the unclaimed money fund is conditioned upon the holder notifying the attorney general and the Texas State Treasurer within a reasonable period from the time the holder receives a claim with regard to property already remitted to the Texas State Treasurer. Provided that proper notification is made, the holder's indemnification shall include the amount paid into the unclaimed money fund for that claimant's account, reasonable attorney fees, court costs, interest, and other monetary damages.
- (b) The defense provided by the attorney general in the Property Code, Title 6, §74.304(c), shall include the defense, trial, and appeal, or settlement of any and all claims for damages against holders caused by holder's payment of unclaimed property to the Texas State Treasurer in good faith, as defined in the Property Code, Title 6, §74.304(e).
