1. (a) A permit issued under this subchapter shall specify:

   1. (1) the name, telephone number and physical address of the permittee;
   2. (2) the water body where the activity is permitted;
   3. (3) the fish species for which take and/or sale is allowed; and
   4. (4) the types and number of devices that are lawful for use in permitted activities.
2. (b) A permit issued under this subchapter is not transferable or assignable.

3. (c) At all times that a person designated as an assistant is engaged in a permitted activity, that person must be:

   1. (1) on board the same vessel with the permit holder; or
   2. (2) within line-of-sight of the permit holder if not on a vessel.
4. (d) The permittee and assistant(s) must have in immediate possession a copy of the permit.
5. (e) No person may be listed as a permittee or assistant to a permittee on more than one valid permit.
6. (f) Permits may be amended twice yearly.
7. (g) Requests for amendments must be submitted to the department in writing and should be received 30 days prior to effective date.
8. (h) All permits issued under this subchapter expire on December 31 of the year issued.
