31 Tex. Admin. Code § 371.82
After the construction contract is awarded, the applicant shall provide for adequate inspection of the project by a registered professional engineer and require the engineer's assurance that the work is being performed in a satisfactory manner in accordance with the approved plans and specifications, other engineering design or permit documents, approved alterations, and in accordance with sound engineering principles and construction practices. The executive administrator is authorized to inspect the construction and materials of any project at any time, but such inspection shall never subject the State of Texas to any action for damages. The executive administrator shall bring to the attention of the applicant any deviations from the approved contract documents. The applicant and the project engineer shall immediately initiate necessary corrective action.
