1. (a) Eligible land costs include the purchase of land if the land is necessary to locate the project and the sale is from a willing seller. Acquisition of real property or real property interests are not eligible costs unless the acquisition is integral to an authorized project.
2. (b) For the source water protection program, acquisition of land or conservation easements from a willing seller or grantor is eligible for loan assistance if the purpose of the acquisition is to protect the source water of a public water system from contamination and to ensure compliance with national primary drinking water regulations.
