1. (a) Land costs are eligible for funding only if the land is necessary for the purpose of locating eligible project components and only if the land is acquired from a willing seller.
2. (b) Acquisition of land or of conservation easements from a willing seller or grantor is eligible for financial assistance for source water protection only if the purpose of the acquisition is to protect the source water of a public water system from contamination to maintain or achieve compliance with national primary drinking water regulations.
