In accordance with the Texas Water Code, §15.435, the executive administrator shall assure in using funds provided under this chapter, that:

1. (1) the use of the funds will promote agricultural soil and water conservation;
2. (2) the expenditures are made in compliance with the Constitution, the Texas Water Code, other laws of this state, rules of the board, and legislative appropriations; and
3. (3) priority in expenditure of the funds will be given to those areas of the state that have the most critical water conservation need and to the activities that will most likely produce substantial agricultural soil and water conservation.
