31 Tex. Admin. Code § 353.9
The board hereby delegates to the executive administrator the authority to appoint a department employee, who is an attorney licensed to practice law in this state, to conduct a hearing and to make a written report to the board on any matter to be considered by the board, including, but not limited to, consideration of a petition to the board for the adoption of a rule. The board may direct the executive administrator to appoint a department employee, who is an attorney licensed to practice law in this state, to conduct a hearing and to make a written report to the board on any matter before the board.
