- (a) No person may cause, suffer, allow, or permit the storage, treatment, transport, reuse, or disposal of petroleum-substance waste except as authorized by this subchapter and the rules of the commission.
- (b) Notwithstanding subsection (a) of this section, a person may apply for a variance from the requirements of this subchapter. The executive director shall have the sole discretion to grant a variance, if in his opinion the requirement(s) of this subchapter is/are not practical or reasonable under the circumstances. Any request for a variance must be in writing and of sufficient detail to allow the executive director to make an informed determination. A request for variance must be approved by the executive director before a person may perform an activity or procedure which is not specifically authorized by this subchapter.
