- (a) Purpose. The purpose of this subchapter is to establish the criteria by which target concentrations are established for leaking storage tank site cleanups.
- (b) Applicability. The provisions of this subchapter are applicable to owners and operators of all underground storage tanks and petroleum product aboveground storage tanks unless otherwise specified in Subchapters A and F of this chapter (relating to General Provisions and Aboveground Storage Tanks) respectively. These rules supersede previous cleanup guidelines as published in the January 1990, Guidance Manual for LPST Cleanups in Texas. All leaking storage tank cases which are not eligible for closure pursuant to the cleanup guidelines as published in the January 1990, Guidance Manual for LPST Cleanups in Texas as of the effective date of this rule shall be re-evaluated by the owner and operator under this rule to establish target concentrations unless the executive director has provided written approval of a remediation plan to clean a site to a specific numeric target concentration and the remediation plan has been initiated prior to the effective date of these rules.
