1. (a) Recording required. A person may not cause, suffer, allow, or permit the disposal of municipal solid waste prior to recording in the county deed records of the county or counties in which the disposal takes place a metes and bounds description of the portion or portions of the tract of land on which disposal of solid waste will take place.
2. (b) Proof of recordation. A certified copy of the recorded document shall be provided to the executive director prior to instituting disposal operations.
3. (c) Final recording. Upon completion of the disposal operation and final closure of the facility or site, the operator/owner shall file an "Affidavit to the Public" in a form provided by the executive director that includes an updated metes and bounds description of the extent of the disposal areas and the restrictions to future use of the land in accordance with §330.253(e)(8) of this title (relating to Closure Requirements for MSWLF Units that Receive Waste on or after October 9, 1993, and MSW Sites).
