A water right is subject to cancellation in whole or in part for 10 years nonuse. When the records of the commission show that all or a part of the water authorized to be appropriated has not been used during the immediately preceding 10 years, the executive director may request the commission to issue notice and convene a hearing to determine whether a water right should be canceled, in whole or in part.
