The executive director shall determine whether the proposed activity will:

1. (1) result in any discharge;
2. (2) result in any violation of the Federal Clean Water Act, and the criteria in §279.11(c) of this title (relating to Final Commission Action on Department of the Army Permits) for 404 permits;
3. (3) result in any violation of applicable water quality standards; or
4. (4) result in any violation of any other appropriate requirements of state law.
