Liability for penalties may result and may subject a noncompliant person to enforcement proceedings initiated by the executive director if there is failure to comply with:

1. (1) any provision of this chapter;
2. (2) an approved or conditionally approved Edwards Aquifer protection plan; or
3. (3) any applicable regulation or order of the commission issued pursuant to this chapter and in accordance with Chapter 26 and other relevant provisions of the Texas Water Code or Texas Health and Safety Code.
