1. (a) Each applicant for a license must pass the appropriate examinations. Examinations may be supplemented by practical tests or demonstrations necessary to determine the applicant's knowledge and ability.

   1. (1) The license examination will include a section on this chapter and the Insurance Code, Article 5.43-2, and a technical qualifying examination:

      1. (A) to be conducted by the state fire marshal's office; or
      2. (B) to be conducted by NICET.
   2. (2) The standards used in examinations will be those adopted in §34.607 of this title (relating to Adopted Standards).
2. (b) Examinees who fail must file a reexamination application accompanied by the required fee in order to be reexamined on the next scheduled examination date.
3. (c) A person whose license has been expired for two years or longer who makes application for a new license must take and pass another examination. No examination is required for a licensee whose license is renewed within two years of expiration.
4. (d) An applicant may only schedule each type of examination three times within a twelve-month period.
