28 Tex. Admin. Code § 3.4001
The purpose of these sections is to exempt certain life and accident and sickness policy forms and annuity contract forms from certain of the requirements of the Insurance Code, Article 3.42. Article 3.42 requires that these forms may not be delivered, issued, or used in Texas unless they have been filed for review for approval with the State Board of Insurance as provided in Article 3.42, §(d). Article 3.42, §(f), provides for exemption by the board of policy forms from the requirements of Article 3.42 under certain circumstances. These sections exempt the forms specified from the requirement that they either be approved before being used or reviewed after being used as provided in Article 3.42, §(d)(1). However, these sections do not exempt such forms from the requirement that they be filed before being used. An additional purpose of the sections is to expedite the review process of forms filed under the Insurance Code, Article 3.42.
