28 Tex. Admin. Code § 3.4101
These sections provide for exempting certain contracts or coverage from the requirement in the Insurance Code, Article 3.42, that such contracts or coverage be filed for review with the State Board of Insurance before being delivered, issued, or used in this state; this exemption is applicable only if the coverage is otherwise authorized for use in this state and is appropriate under the Insurance Code, Article 3.42, as if no provision for exemption existed. The exemption is for 45 days from the effective date of the coverage or until a later date as provided in these sections. The board has determined that the filing of certain forms or coverage before it goes into effect is not desirable or necessary for the protection of the public, and further that the requirement in the Insurance Code, Article 3.42, that such forms be filed for review with the State Board of Insurance before being delivered, issued, or used in this state may not practicably be applied to such forms or coverage prior to its issuance or delivery in Texas.
