28 Tex. Admin. Code § 11.1704
An ANHC with a certificate of authority or provisional certificate of authority under Insurance Code, Chapter 844, and this subchapter shall be subject to the same statutes and rules as an HMO and considered an HMO for purposes of regulation and regulatory enforcement.
