This chapter implements the Insurance Code Chapters 843, 1271, 1272, 1367, and 1452, and other applicable insurance laws of this state that apply to HMOs.

1. (1) Severability. Where any terms or sections of this chapter are determined by a court of competent jurisdiction to be inconsistent with the Insurance Code Chapters 843, 1271, 1272, 1367, or 1452, or other applicable insurance laws of this state that apply to HMOs, the applicable chapters of the Insurance Code will apply, but the remaining terms and provisions of this chapter will continue in effect.
2. (2) Effect of rules. The sections in this chapter are prescribed to govern the performance of appropriate statutory and regulatory functions and are not to be construed as limitations upon the exercise of statutory authority by the commissioner of insurance.
3. (3) Violation of rules. A violation of the lawful rules or orders of the commissioner made pursuant to this chapter constitutes a violation of the Insurance Code Chapters 843, 1271, 1272, 1367, and 1452 and other applicable insurance laws of this state that apply to HMOs.
